Terms of Service

These terms govern the use of this website and the Visibool Tech client portal. They do not govern the work itself — that is covered by the written agreement for your project, which takes precedence over anything here.

Accepting these terms

By using this website, or by signing in to the client portal, you agree to these terms. If you are using the portal on behalf of an organisation, you confirm you are entitled to accept them for that organisation.

Our services are provided to businesses. These terms are written on that basis and do not restrict any rights a consumer would have.

What these terms cover

Visibool Tech is a technology services company. We build and support web applications, software, mobile apps, cloud infrastructure, networks and security for other businesses. The client portal is where a project is set up and run: describing what you need, answering our questions, exchanging files, recording requirements and keeping the conversation in one place.

The portal is a tool for running a project, not the agreement for it. Scope, price, timescales, warranties and who owns what are set out in the project agreement or statement of work we sign with you. Where anything in these terms conflicts with that agreement, that agreement wins.

Portal accounts

  • Accounts are created by invitation only. There is no public sign-up.
  • An account belongs to one person. Do not share credentials — if a colleague needs access, ask us and we will invite them.
  • You are responsible for keeping your password to yourself and for activity carried out under your account. Tell us straight away at hello@visibool.com if you think it has been compromised.
  • Everyone with an account in your organisation can see all of that organisation’s projects, files and messages. There is no private area within an organisation.

Acceptable use

Use of the portal is subject to our Acceptable Use Policy, which forms part of these terms. In short: do not upload anything unlawful or malicious, do not try to reach another organisation’s data, do not scrape or overload the service, and keep within the posted file size and format limits.

Intellectual property

Ours

The design, text, code and branding of this website belong to Visibool Tech. Nothing here transfers any of it to you.

Yours

Anything you upload or write in the portal remains yours. You grant us permission to store it, process it and share it with the people working on your project, purely so that we can do the work. We claim no other rights over it.

Work we produce for you

Ownership of the software, designs and documentation we produce is decided by your project agreement, not by these terms. If that agreement is silent, ask us and we will put it in writing rather than leave it to be inferred from this page.

Availability and data

We aim to keep the portal available, but it is provided as-is and without any guaranteed level of uptime. It is a convenience for running a project; it is not a system of record and should not be your only copy of anything.

Keep your own copies of files you upload. We take backups, but we do not warrant that any particular item can be recovered from them, and we are not liable for data you have not kept elsewhere.

How long we keep things, and what happens when you withdraw a file, is set out in our Privacy Policy.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

Subject to that:

  • We are not liable for indirect or consequential loss, loss of profit, loss of business, loss of goodwill or loss of anticipated savings.
  • Our total liability arising out of or in connection with the portal and these terms is limited to the fees paid to us for the project the claim relates to.
  • Liability for the work itself is governed by your project agreement, and that agreement’s limits apply in place of this section where the two overlap.

Ending access

You can ask us to close your portal account at any time. We may withdraw access if these terms or the acceptable use policy are seriously or repeatedly broken, or when a project has finished and the portal is no longer needed.

Losing portal access does not end any contract between us and does not affect anything either side already owes the other. Your data is retained and disposed of as described in the Privacy Policy; ask us before access ends if you want a copy of anything.

Changes to these terms

We may update these terms as the service changes. The date at the top shows when they last changed. If a change materially affects portal users we will tell account holders directly rather than rely on the page being noticed.

Governing law

These terms are governed by the law of England and Wales.

If something goes wrong, please contact us first at hello@visibool.com — nearly everything is resolved by a conversation. Where it is not, the courts of England and Wales have exclusive jurisdiction.
